ANÁLISE DA RESPONSABILIDADE PENAL DOS POVOS INDÍGENAS NO BRASIL

Abstract

This research aimed to analyze and understand the process of holding indigenous peoples accountable, being a topic that encompasses human rights and cultural recognition, requiring attention and effective actions to guarantee justice and the preservation of their identities. In order for this responsibility to take effect, it is necessary to verify the aspects of integration of the indigenous people in society, involving the process of inclusion of these people in social contexts, checking to what degree they are, assuming that their criminal responsibility will increase by according to its integration degree. Therefore, the present study will be based on bibliographical, qualitative and quantitative research. The approach method used is deductive and dialectical; explanatory and descriptive. Based on the information obtained, a reflection is made in the sense that the cultural rights declared to indigenous people must be particularly recognized, but there is also the need for the recognition of a democratic State of rights, where all those who have a relationship in society, must obey to the laws contained therein
