OBSERVATÓRIO JURÍDICO: UM PANORAMA DA IMPLEMENTAÇÃO DAS NOVAS TECNOLOGIAS NO JUDICIÁRIO BRASILEIRO

Abstract

This article investigates the gains achieved by the adoption of new technologies in the Brazilian Judiciary, considering the challenges that need to be faced by this system, especially with regard to guaranteeing human rights and access to justice. The conclusion is reached both through the study of existing literature and through considerations on how the different characteristics of the general development of technology, as well as technological novelties such as artificial intelligence (AI), digital platforms and automated systems, can help to improve judicial processes, reducing waiting times and making access to justice system units a more favorable experience. In addition, the research examines how these tools contribute to social inclusion through the democratization of access to judicial services, particularly for marginalized populations. The research proposes the digital transformation of the legal framework within the limits established by the Brazilian national legal system, being consistent with the obligations generated by Brazil's participation in international human rights treaties and respecting the existing demands for a more efficient, accessible and ethical judicial system. In contrast, this modernization is explored for the challenges it imposes, such as ethical considerations, training of professionals, safeguarding individual privacy and the need to ensure that the application of technology is consistent with the principles of justice. Despite the proposed obstacles, it is considered that the introduction of technologies can positively revolutionize the Brazilian Judiciary, constituting a fairer and more inclusive process, adapted to the incessant changes in society
